Feds Rule Texas Special Education Law Invalid

The Federal Government ruled last week that Texas Education officials illegally denied special education services to students across the state, reports The Austin American-Statesman.

The ruling rejected a long-ago decision by the Texas Education Agency that placed a cap on how many students in the state can be eligible for special education services.

The 2004 Texas decision declared that no more than 8.5 percent of the students in Texas should be allowed to access special ed assistance.

The law was part of an effort to ease the Texas education budget. However, that policy meant kids with learning disabilities who didn’t land in that 8.5 percent were left to struggle in regular classes. Steven Aleman, a spokesman for Disability Rights Texas, said the report came as “no surprise” to the families of the affected students.
